Case of Woman Killed By Apparent Drunk Driver Reopened

Case of Woman Killed By Apparent Drunk Driver Reopened - Thursday, February 28, 2008 at 11:22PM EST

PHILADELPHIA- New, never-before-public details are emerging about the 2005 death of Wayne County woman.

Reports indicate Diane Glynn was killed when a truck crossed the center line and plowed into her car. The driver of that truck, according to an attorney for Glynn's family, is the stepson of a Pennsylvania State Police corporal.

Attorney Mark Tanner represented Glynn's estate and her three children in a civil matter with the driver he says took Glynn's life, Dean O'Halloran. Tanner calls the response by investigating officers with state police at the scene of the accident "inadequate." It's alleged O'Halloran received special treatment because of family ties.

Accident reports show Glynn was killed around 9 a.m. April 15, 2005. She was on her way to work. Eyewitnesses described a yellow truck driving and swerving from side-to-side down Route 590. That Penske truck, operated by O'Halloran, slammed into Glynn's Dodge Neon and pinned against a guide rail. Glynn was apparently killed on impact.

The civil matter brought by Tanner was settled only last week. He says the proceeds will allow Glynn's children means to live. But Tanner isn't resting yet. He's pushing for the case to be reexamined by authorities, though the Wayne County District Attorney told the I-Team Thursday, this is the first he's seen the reports and details.

Tanner told us from his Philadelphia office that O'Halloran was never given sobriety or blood alcohol tests by state police investigators. Records also show O'Halloran had been involved in another accident earlier that same morning, a hit-and-run, just three hours before Glynn was killed. More records show O'Halloran eventually had a blood-alcohol test at the hospital. The results showed a level close to double the legal limit, hours after the accident.

Attorney Tanner is pressing for a criminal investigation. Wayne County District Attorney Michael Lehutsky said Thursday afternoon he had no knowledge of the case prior to this week.

State police confirm the case is still open.
