D.A. Announces Arrest Related to "Sexting" Controversy - Wednesday, April 22, 2009 at 6:00PM EST

TUNKHANNOCK, WYOMING COUNTY- There are new developments in the "sexting” controversy in Wyoming County. Wednesday police said they have a scary example what can happen when nude photos are put on cell phones.
The Wyoming County District Attorney says this is a story all parents should read very closely. This case began last November. Some students say they were being picked on by the D. A.

Now there is a scary new twist to the story. Investigators say 52-year-old Scott Swanson of Georgia was trying to set up a sexual rendezvous with a 14-year-old female student at Tunkhannock Area High School that he met on line.

The girl sent him naked photos of herself that she took on her cell phone. She was one of dozens of students caught up in the "sexting" controversy at the high school.

She and others were offered a deal to take part in an education program and they would not be arrested.

One student and the A. C.L. U sued District Attorney George Skumanick, saying the move violated their civil rights and this was an issue of freedom of speech.

A federal judge ruled in favor of the student and ordered the D. A. to hold back on charges. But now Skumanick says this arrest proves his point - safety first. "Clearly this shows the dangers of putting photos out there for kids of any age, especially your kids. This is what we were concerned about in the first place. That's why we and the district took the actions we did," said Skumanick.

Chief Detective Dave Ide says this case should send a clear warning to all parents. "Parents have to be vigilant for their kids and find out what is being done on their cell phones and computers and text messages. The bad guys are out there."

Skumanick will likely use this investigation as an example of what can happen when he argues his case in front of a federal judge. Again he has appealed the judge’s ruling, saying it could jeopardize all criminal investigations across the country.
