Deadly Purchase

COOLBAUGH TOWNSHIP, MONROE COUNTY - A woman accused of buying the gun that killed a State Trooper is heading to court. A judge decided there is enough evidence to send Emily Gross to trial. Eyewitness News was the only station in Monroe County for her court hearing.

Police say Emily Gross bought her boyfriend, Daniel Autenrieth, a handgun. In June he shot that weapon at two State Troopers. He killed Trooper Joshua Miller and injured Trooper Rob Lombardo.

This time line came out during court testimony:

May 4, 2009
Daniel Autenrieth receives a protection from abuse order because he had allegedly threatened his estranged wife. He was not home to accept the order so Emily Gross accepted it on his behalf.

May 21, 2009
Emily Gross attempts to get a permit to buy a gun in her home State of New Jersey but does not want to go through the mandatory waiting period.

May 29, 2009
Emily Gross uses Daniel Autenrieth's address to get herself a Pennsylvania Driver's License.

May 29, 2009
Emily Gross and Daniel Autenrieth drive at least an hour to a buy a gun together.

June 7, 2009
Daniel Autenrieth threatens his wife with that gun. Then he leads police on a chase that ended in a deadly shoot out.

Assistant District Attorney Mike Mancuso said,"It's clear evidence that the defendant was aware of the restrictions that Daniel Autienrieth had by virtue of the PFA and despite that went to these extraordinary lengths to get him a gun."

Gross's attorneys declined to speak with Eyewitness News.

During testimony - prosecutors showed the gun that killed Trooper Joshua Miller. It's the first time his family saw the weapon and many of them broke down in tears. Joel Miller is Trooper Millers brother. He said, "I didn't want to keep looking at it. I can't stand the sight of it."

Gross showed no emotion in court. Miller reacted, "She's not upset. She's just going through it. She doesn't know what we've been through, what we're still going through and what we will be going through for the rest of our lives."
