PLAINS TOWNSHIP, LUZRNE COUNTY- A Plains Township man remains behind bars after being charged with causing the death of his father last week. Prosecutors said what Ernest Zalaffi, Junior did was not intentional, but still a crime.

Police charged the 37-year-old with Involuntary Manslaughter Wednesday morning. Investigators said he fought with and assaulted his father even though he’s had a heart condition for the last five years. That fight unintentionally led to his father's death.

“I love my dad and I miss him very much” declared Ernest Zalaffi, Junior. He was choking back tears as he was hauled off to prison Wednesday morning after being charged in connection with the death of his father, Ernest Zalaffi, Senior.

The 65-year-old suffered a heart attack inside his East Saylor Avenue home last Sunday night after getting into a verbal and physical confrontation with his son.

Luzerne County District Attorney Jackie Musto Carroll explained how they arrived at the decision to file the charges they did. “This was involuntary manslaughter in that it was reckless and grossly negligence conduct for the son to engage in this behavior and assault his father, knowing the father had a pre-existing heart condition."

Investigators said Zalaffi was wrestling with his father during the fight, and even taunting him, calling him weak.

Assistant District Attorney Jarrett Ferentino declared “When someone is assaulted and the perpetrator commits criminal acts on a person they know to have a heart condition and a heart attack results, they are responsible for that death."

Court papers indicate the younger Zalaffi had a problem with drugs and alcohol in the past and drank the day the fight took place.

“This is a horrible tragedy for this family. Through the investigation we learned they are a close family" stated Musto Carroll.

Bail for Zalaffi was set high at one million dollars because his family no longer wants to see him.

“This incident is going to affect them for the rest of their lives. But the defendant’s conduct was criminal and it was simply inexcusable" declared Musto Carroll.

Zalaffi faces a preliminary hearing early next month.

This is not the first homicide by heart attack case in Luzerne County. Two years ago Edward Longfood was arrested for fighting with his dad who also caused his death.
