Embattled Judge Lokuta May Return To Bench - Tuesday, November 17, 2009 at 5:50PM EST

HARRISBURG, DAUPHIN COUNTY- Weighing the evidence, suspended Luzerne County Judge Ann Lokuta could get a break. Asked what punishment she should face in light of a mushrooming corruption scandal at the courthouse, Lokuta said she would submit to a term of probation and monitoring. Lokuta said she's lived her sanction.

At a hearing Tuesday Lokuta was expected to present newly discovered evidence since two judges were wrapped up in a corruption probe that has snared 19 people. Instead, the suspended judge testified she should be returned to the bench because two ex-judges allegedly ramped up 30 witnesses to bolster claims against her. Lokuta's attorneys claim all the witnesses were singing from the same hymnal when they appeared on behalf of the Judicial Conduct Review Board.

The board said it did not believe the corruption scandal played any role in the claims made against Lokuta. Board Prosecutor Frank Puskas said they were two worlds independent of each other.

The Court of Judicial Discipline did not give a timetable on when it may rule on Lokuta's case.
