WILKES-BARRE TOWNSHIP, LUZERNE COUNTY- Many of you are returning unwanted holiday gifts. In some cases, cash refunds are given, but some retailers have exchange-only refund policies. A Wyoming man wanted a cash-only refund, after his gift caught fire.

Jim Endres bought a remote control helicopter from a kiosk in the Wyoming Valley Mall. It fits in the palm of your hand, and can fly through the air. But the mini euro tiger helicopter caused problems for Endres. "It looks like the battery exploded and then the rest of it caught flames," says Endres.

This helicopter was a gift for Endres' 10 year old daughter. But Christmas night, they left it charging on their coffee table, and it went up in flames. But Endres is fired up over J and F Helicopters return policy, which is exchange only, and no cash refunds.

Endres says, "the receipt was stamped exchanges only and I understand that if the item was defective or something like that, but I'm just a little surprised with something that poses this much of a safety hazard that he wouldn't give me my money back."

Endres came to WBRE news after he says j and f wouldn't budge when he tried returning the toy. He says the helicopter was dangerous, and didn't want an exchange. Mall staff says if Endres would have filled out a complaint form first, they could have helped earlier.

Wyoming Valley Mall Marketing Director Joe Ohrin says, "if you inquire ahead of time and know they've got no-cash refunds and you're not comfortable with that, then you're better off not buying it."

More people were returning the helicopter Thursday afternoon here at J and F's kiosk. Endres would like to see their exchange policy changed, if more copters end up like his.

With our story and mall staff's help, J and F's manager agreed to give Endres a full refund of $35. We talked to the manager late Thursday afternoon, he says this is the first helicopter he's sold that caught fire.
