Harshbarger Hearing

Harshbarger Hearing - Saturday, January 17, 2009 at 12:10PM EST

Wilkes-Barre, Luzerne County -

Mary Beth Harshbarger says nothing as she comes to federal court in Wilkes-Barre on Friday. Canadian authorities says she was negligent in the death of her husband Mark in 2006 while hunting in Newfoundland . Mark's family insists she is a murderer.

Dean Harshbarger, the victim’s brother says, "I personally feel she intended to get rid of him yes, that's my own opinion and I won't change that."

Mary Beth talked with Andy Mehalshick exclusively a year after the hunting trip at the home she shared with Mark in Meshoppen. She showed Andy their wedding album and says they were deeply in love and she could never hurt him.

Mary Beth Harshbarger, in September 2007 said, "I loved my husband very, very much. He loved me as much. What would he say about these rumors? He wouldn't be really happy at all."

But Mark Harshbarger’s family and friends insist Mary Beth loved money and control.

Carol Bawiec, Mark Harshbarger's friend says, "She probably loved him in her own way. I'm sure she loved him but its just what does she love more? She was very competitive and was a sharpshooter."

But defense lawyers argue the killing was a tragic mistake.

Paul Ackoury, the defense lawyer says, "Well all I can tell you is that the Canadian authorities on two occasions conducted re-enactment using the same lighting and the same circumstances. Investigating officers indicated in their report it was reasonable."
