SCRANTON/LACKAWANNA COUNTY --The owners of a Gouldsboro fuel company that shut down last December appeared in court Thursday. Only Eyewitness News was there to ask why they left so many customers out in the cold.

Arthur and Beverly Baio appeared for a bankruptcy proceeding. The couple --who now lives in New York --claims they are millions of dollars in debt. But here's where the story gets confusing. The Baio's are being investigated by the Attorney General but their lawyer says they've reached a settlement.

“There's over 1000/1100 people that paid you money, prepaid contracts. You didn't deliver. Arthur and Beverly Baio kept quiet as they left a bankruptcy meeting in federal court Thursday. "Do you have anything to say to people who were left without hundreds or thousands of dollars?"

Last December, the couple suddenly closed A&B Fuel and All-County Petroleum in Gouldsboro after accepting prepaid contracts from customers like Gladys Frank.

"I think they just don't care. I think they're very arrogant."

The Baio's attorney says he's advised his clients to keep quiet...but says they are sorry.

"The time I have spent with them. They are incredibly remorseful. This is their life business, put all savings into this business, they've done everything in their power to save the business and accepted those deposits in good faith under the belief that the business was going to continue and go forward."

Ron Santora says someone else had promised to take over the business for the Baio's last year. That person never did --and that's why the business closed. Now the Baio's are suing.

Ron Santora “Is anyone going to get any money back? We have settled with the attorney general of the commonwealth of Pennsylvania. I believe we have satisfied him as to what occurred. Whether they'll be anything left for the customers will depend on the outcome of litigation."

But the spokesman for the attorney general’s office tells the I-Team they have not reached a settlement. Nils Frederickson says “we continue to work to hold the Baios fully accountable for their actions; for the losses consumers suffered and for violations of consumer protection laws.”
