LUZERNE COUNTY- 28-year-old David Gula is brought into an interview area of the Luzerne County prison. He is handcuffed and shackled.
A jury found him guilty of sexual assault of a 90-year-old woman at the Kingston Commons Nursing home last year. The testimony was very graphic. A nurse testified she saw Gula on top of the victim, with his pants off.
Gula insists he is innocent. "Everybody is changing their story about what happened, from one thing to another, my pants are down, then there off, to her seeing me on the bed, she hears bed springs. It’s an air mattress everything just changes," he says.
Andy asks, "How does a bodily fluid get on the bed, or why is it on your hands in the room?"
Gula responds, "I don't know but if I worked a whole shift before, if my pants and everything was off how come my sweat and everything was not on her bed nothing on her sheets her clothing nothing."
Andy questions, "Can you talk to the people at home in that camera, tell them you didn't sexually assault a 90-year-old woman?"
Gula responds, “I did not sexually assault the 90-year-old woman."
Andy asks, "What about physical evidence on body or bed how it ends up on her?"
Gula answers, "One hair? Look how hairy I am? If I had my pants off I was only one hair from me, one hair?"'
