WILKES-BARRE, LUZERNE COUNTY- There is new information in an exclusive I-Team story involving the alleged assault of an inmate at the Luzerne County Prison. That case is being investigated by the D.A.'s office and the FBI.

That inmate, 23-year-old Jimmy Menninger, suffered a broken jaw and nose and suffered eye damage. Now his lawyer, Barry Dyller, tells us they want answers, and are ready to take the county to court to get them. "It does appear that we will sue. There are medical records which we do have that really show that a bad thing happened," he said.

Dyller represents former inmate Jimmy Menninger of Larksville. Menninger suffered severe injuries when he was in the prison in early March. He can barely speak, but described his injuries to us last week.

"When I got hit on the floor, my nose completely cracked to the right side, my orbital bone is fractured, my cheek and jaw plate set from the force of fist and pressure on my face being slammed off cement floor," he said.

Menninger admits he called one of the guards an off color name and that led to, what he calls a relentless beating. Medical records obtained by the I-Team shows, even the emergency room doctor did not believe the story that he fell from his bunk bed.

Dyller says those injuries raise lots of questions. "Well, everybody in prison may supposedly be innocent, but not everybody in prison has fractured bones of the face. Not everybody in prison has 7 hours of surgery. Not everyone in prison had to tell them that they fell."

County officials say they will not comment on this case because of pending legal action. Last week Warden Gene Fischi did say that his internal investigation shows that Menninger was the aggressor and that he and his staff are cooperating with the D.A.s' office.
