WILKES-BARRE, LUZERNE COUNTY- There is new information on a story the I-Team broke last week. It involves the alleged assault on an inmate at the Luzerne County Prison. We learned Friday the FBI has stepped up its investigation. That inmate suffered a broken jaw, cheek and nose, and his lawyer says he is not getting any cooperation from county officials.

23-year-old Jimmy Menninger was released from prison last week. He still suffers from injuries he said were inflicted by several prison guards at the Luzerne County Prison. "When I got hit on the floor my nose completely cracked to the right side, my orbital bone is fractured, my cheek and jaw broke from the force of the fist and pressure on my face being slammed off the cement floor," described Menninger.

He admits he called a guard an off color name. That's when he said he was brutally beaten. His lawyer Barry Dyller has requested but has not received any information or records from Luzerne County. "Asking them to reconsider providing those records so we can do a full investigation and evaluation. It makes perfect sense otherwise we have no choice but to institute a lawsuit," said Dyller.

County officials will not make any comment on camera due to possible legal action, but last week Warden Gene Fischi said his internal investigation showed that Menninger was the aggressor. He has turned his information over to county detectives.

"Well, I certainly would like Luzerne County to do a thorough investigation. In my experience, that isn't always the case, that if the guards say we did nothing wrong they take it at face value. I hope they look beyond that in this case," said Dyller.

We do know that the FBI interviewed Menninger on Thursday. They also had him sign paperwork so they can obtain his medical records.

The Luzerne County District Attorney is also investigating. County officials say they never release any records from internal investigations like this, unless they are subpoenaed.
