WILKES-BARRE, LUZERNE COUNTY -- A Luzerne County judge has ruled mass murderer George Banks incompetent to be executed. That decision was made by Judge Joseph Augello late Wednesday afternoon.

Banks returned to a Wilkes-Barre courtroom last month when testimony was offered in the case for and against execution.

Luzerne County District Attorney Jackie Musto-Carroll says she has not seen the ruling but is disappointed. She and the Attorney General's office will consider filing an appeal.

Banks' attorney Al Flora says he hasn't seen the ruling either.
