Monday May 17 2010
STROUDSBURG, MONROE COUNTY - A judge sentenced Thomas Senavitis to time served - that's three hundred days. Now he'll spend about thirteen months out on parole. His wife Dolores said, "He's back home with me and that's the best part. I don't want to lose him again."

While his wife said she was glad this is overSenavitis didn't have much to say at all. He said simply, "We'll see what happens." The sentence also requires Senavitis pay a thousand dollar fine, take a driving safety course and give up his license for a year.

His attorney Wes Niemoczynski said, "At least it brings finality."

Niemoczynski received an award for his work on the case. He said, "I really couldn't have done it without my staff here at the public defenders office."

The Alan Jay Josel Advocacy Award is presented to an attorney who does excellent work under difficult circumstances. Niemoczyinski told us the Senvatis case had significant challenges. He explained, "T here was as i understood it some reluctance from some folks who may have seen things to speak about it."

The case revolved around an October 2008 accident on Route 209 in Gilbert. Police claimed Senavitis had a blood alcohol content four times the legal limit when he drove into the lane of Senator James Rhoades.

The defense argued the Senator left his lane.

The jury found Senavitis not guilty ofvehicular homicidebut guilty of drunk driving. Now his attorney said Senavitis is ready to put this all behind him. He said, "He doesn't try to hold any grudges or anything like that. Just wants to move on and be with his grandchildren and hopefully get back to work."

The Senator's wife Mary was severely injured in the crash. She did not attend the sentencing. The Rhoades family did not release a statement.
