Wegman's Beer Sales Approval Upheld - Tuesday, February 24, 2009 at 4:23PM EST

Williamsport, Lycoming County-
A state court has upheld the Pennsylvania Liquor Control Board’s approval of beer sales at Wegman’s grocery stores.

Wegman’s owners are calling it a “small victory.”

A unanimous decision in Commonwealth Court will allow patrons to continue purchasing up to two six-packs of beer for take-out.

Local Wegman’s stores have been selling beer for about a year now. Store managers tell me the venture has been quite successful so far.

Customers can also enjoy a beverage while eating at Wegman’s restaurants, including the one here in Williamsport.

Ruth Lugg, of Lock Haven, said, “If you’re a beer drinker and you like beer, it’s much more convenient to buy in the supermarket, and they do have quite a variety.”

The ruling could bring Pennsylvania into line with other states that have more relaxed laws on beer sales.

Lugg noted, “We’ve purchased it in New Jersey for years. I came from New Jersey. And it’s been going on for a long time with wine and everything.”

But the battle is far from over. And not everyone is thrilled with the decision.

Lugg added, “The only thing that I would say is that if you’re against drinking, maybe that would be offensive to you.”

It’s also offensive to beer distributors, who say the ruling will cut into their profits.

Distributors in Pennsylvania have historically dominated take-out sales, but they can only sell beer by the case.

They also fear the decision will prompt other businesses to try adding beer sales to their bottom line.

Lawyers for the Pennsylvania Malt Beverage Distributors Association say they will appeal the decision to the state supreme court.

Monday’s court ruling applies to the Wegman’s stores in Williamsport and Bethlehem.

The court is expected to issue separate opinions for other Wegman’s locations throughout the state.
