What To Do If You Own A Recalled Toyota

What To Do If You Own A Recalled Toyota - Wednesday, January 27, 2010 at 6:34PM EST

SCRANTON, LACKAWANNA COUNTY --So what do you do if you're one of the millions who own a recalled Toyota? That's the big question tonight after Toyota production and sales of eight models. Consumer investigator Jeff Chirico has advice.

The recall affects 8 models of Toyotas. Some report the gas pedal gets stuck. Others say their cars accelerate out of control. Unfortunately, there's no fix for this right now --so millions of Americans are left worrying whether this could happen to them.

Just four weeks after buying a 2010 Camry, Joe Sadowski is back at Scranton Toyota --asking what he should do with his recalled car. “All I was told is I'll get a letter. They don't know how to fix it yet. Nothing they can do."

Toyota has recalled more than 2 million vehicles, including

2009- 2010 Toyota RAV4 models,
2009-2010 Toyota Corolla models,
2009-2010 Toyota Matrix models,
2010 Toyota Highlander models,
2008-2010 Toyota Sequoia models.
2005-2010 Toyota Avalon models,
2007-2010 Toyota Camry models
2007-2010 Toyota Tundra models

Toyota says there have been reports of cars accelerating uncontrolled. Like this one - in Texas the day after Christmas. The out of control Toyota plunged into a pond- killing four.

Bob Silverman of Lemon Law firm Kimmel and Silverman says "the real problem is Toyota doesn't know when or if a fix will become available because they don't know what the problem is."

So what do you do short of parking your car? The advice is limited. "Toyota says if your car starts to accelerate uncontrolled, press firmly on your brake. Don't pump it. Then shift your car into neutral. If that fails. Turn it off." Turn it off only as a last resort.

If this happens, take it to the dealer and ask that they fix it. If you don't and it happens again, your rights are limited. “Then you can't bring a legal claim because you didn't give them a reasonable opportunity to fix the problem."

Joe says if he would have known about these problems a month ago, he would have bought something else. "I’m a little worried about it. This could be dangerous. I want Toyota to make it right and the dealership to stand behind the people."

The manufacturer will be contacting consumers shortly regarding the recall, however if you have been back to a Toyota dealer in the past complaining of sudden acceleration, you may be entitled to a repurchase, replacement or partial refund under Pennsylvania Lemon Law.
